PRIVACY POLICY
The definitions of some terms are given below :
Agreement refers to the Privacy Policy and any other mutually agreed-upon terms and conditions between Creditr and the User concerning the Services.
Applicable Law refers to any statute, law, regulation, sub-ordinate legislation, ordinance, rule, judgment, order, decree, authorization, approval, directive, circular, guideline, policy, requirement, code of practice, or similar decisions by a statutory or regulatory authority, government agency, or any authority with jurisdiction over the subject matter of this Agreement.
Computer Virus refers any harmful computer program that can damage or interfere with the proper functioning of a computer or attach itself to other computer programs, activating when certain conditions are met.
Confidential Information refers to all non-public information, regardless of its form, related to assets, business processes, policies, services, agreements, transactions, user data, financials, and other sensitive details belonging to Creditr and/or its affiliates or entrusted to Creditr by third parties.
Government Authority refers to any government body, agency, or organization, including those at the state or local level, responsible for executive, legislative, judicial, regulatory, or administrative functions related to the Agreement and the Services outlined in the Agreement.
Intellectual Property refers to exclusive creations such as patents, inventions, trademarks, and confidential information that is not publicly available or naturally falling into the public domain.
Intellectual Property Rights include rights, licenses, applications, and legal protections related to patents, trademarks, copyrights, and other similar rights globally. It encompasses the right to apply for, hold registrations, and seek extensions or renewals. This also includes the right to take legal action for past, present, or future infringements, damages, and profits, as well as any associated Confidential Information.
Prohibited Conduct refers to actions by the user that violate the Agreement or Applicable Law. This includes misuse of the Service, infringement of intellectual property rights, unauthorized access attempts, spamming, storage of unlawful material, and false representation or impersonation.
Services refer to the offerings provided by Creditr in India to platform users. This encompasses access to the website (web.creditr.in) and the Creditr mobile application.
INTERPRETATION
1. Reference to any legislation or law includes its amendments, supplements, or re-enactments over time. It also covers subordinate legislation under that provision.
2. The term 'person' refers to individuals, corporations, partnerships, unincorporated organizations, or governmental agencies. It includes their successors, permitted assigns, legal representatives, administrators, executors, heirs, and trustees in the case of an individual or trust.
3. Headings in sections and clauses are for reference and don't impact the interpretation.
4. Singular includes plural and vice versa, and gender-specific words include all genders.
5. Communication under this Agreement will be through email to support@creditr.in.
Note : Phrases like 'other,' 'otherwise,' and 'whatsoever' should not limit the scope of preceding words or matters mentioned."
ACCEPTANCE OF THE PRIVACY POLICY
Creditr agrees to provide services to the User, who agrees to avail themselves of these services based on this Agreement. The User's acceptance of the Privacy Policy constitutes the Agreement, replacing any prior arrangements. The User commits to being bound by the Agreement each time they access the Platforms, checking the 'I have read and accept the Privacy Policy' box before using the Services.
The User affirms to Creditr that they are 18 years or older and capable of entering, performing, and adhering to this Agreement. Users under 18 may access the Platforms or services only with parental or legal guardian involvement, guidance, supervision, and/or consent. Creditr is not responsible for verifying the User's age.
PRIVACY POLICY
The profile, including User Information, property details, requirements, and other content created by the User, may be viewed by other Users, individuals, and/or Third Party Service Providers accessing the Platforms.
Creditr is authorized to collect and maintain information related to messages sent by the User through the Platforms. This includes message content, phone number, and/or email address, used for logging purposes.
User Information may be utilized by Creditr to share with Third Party Service Providers and to communicate offers for premium services and promotions related to the Services.
Creditr employs standard industry measures to safeguard Personal Information stored in its database. Access to Personal Information is restricted to employees, customer service personnel, and contractors who require it during the course of their employment for service provision."
USER INFORMATION
Creditr is not accountable for the accuracy, quality, integrity, legality, reliability, appropriateness, and Intellectual Property Rights pertaining to User Information.
Creditr is not responsible or liable for the deletion, correction, destruction, damage, loss, or failure to store any User Information, whether in whole or in part.
Creditr reserves the right to deny access, remove, or delete any User Information from the Platforms, either in whole or in part.
Creditr has the right, though not obligated, to retain or forward any User Information and authenticate the authenticity of User Information available through the Platforms or other means.
RIGHTS OF CREDITR
Creditr reserves the right to reject or disable access to Services if the User violates any Applicable Law or breaches this Agreement, among other reasons related to the secure operation of the Platforms.
Creditr can modify, suspend, or terminate all or part of the Services, including features and layout, and may temporarily or permanently suspend or deactivate the User's access to the Platforms without prior notice.
Creditr will attempt to provide advance notice of any suspension or deactivation of the Platforms for repairs, inspections, maintenance, upgrades, or other reasons. Efforts will be made to rectify disruptions or errors on the Platforms promptly.
Creditr has the right to communicate with the User through the Platforms, email, text messages, or other agreed-upon forms, and may send promotional or relevant information about the Services to the User.
UNAUTHORIZED ACCESS
The User is responsible for all activities conducted on the Platforms and must ensure the security of User Information.
In case of unauthorized access or misuse of the Platforms, the User must promptly notify Creditr as per the Privacy Policy. Creditr will take immediate action, including suspension or termination of Services, to address such incidents. It is not liable for any loss or damage resulting from the User's delay or failure to report unauthorized access.
Creditr, following Applicable Law, will securely dispose of records containing User Information after implementing necessary security measures.
USE OF INFORMATION
Creditr is committed to handling, storing, and sharing information, including User Information and Content, in strict compliance with Applicable Law, even after the Services' expiration or termination. The User explicitly authorizes Creditr to utilize User Information for various purposes, encompassing service provision, collaboration with Third Party Service Providers, enabling interactive features, conducting studies, and delivering notifications or promotional messages. To enhance service provision, Creditr may engage Third Party Services, with the User's consent to share User Information as necessary for the agreed arrangement between Creditr and the Third Party Service Providers. This sharing framework operates on a principal-to-principal basis, defining distinct responsibilities, rights, liabilities, and obligations under the pertinent bilateral agreement. Google Analytics might be utilized for tracking and reporting website traffic, employing collected data to tailor ads within Google's advertising network. Creditr provides links to third-party sites within its Services, emphasizing a disclaimer regarding content, privacy policies, or practices on these external sites. For personalized advertising, Creditr may use cookies or similar technologies to analyze User patterns, with the ability for Users to manage cookie preferences, understanding potential impacts on service accessibility. In accordance with Applicable Law, Creditr may disclose User Information to Government Authorities for identity verification, prevention, detection, investigation, and the prosecution of offences. Notably, User Information may be transferred and maintained outside the User's jurisdiction, with Creditr ensuring secure and lawful transfers aligning with its Privacy Policy.
INTELLECTUAL PROPERTIES
Creditr places significant emphasis on respecting the Intellectual Property Rights of others and expects its Users to uphold the same standard. Users are expressly accountable for actions constituting infringement, such as presenting User Information or Content as their own property or utilizing the Content, whether publicly or privately, directly or indirectly, in violation of Creditr’s Intellectual Property Rights. It retains the right to pursue appropriate legal action against any User or third party found to be infringing upon its Intellectual Property Rights, aligning with the stipulations of Applicable Law. Users acknowledge and consent to the commercial exploitation and utilization of User Information by Creditr for purposes outlined in the Agreement. Additionally, Users affirm that Creditr holds Intellectual Property Rights over all information and data shared by the User on the Platforms.
OPERATIONAL HAZARDS/ COMPUTER VIRUS ATTACKS
Creditr provides no warranty that the Platforms or any internal software utilized by Creditr will consistently remain free from potential threats like Computer Viruses, worms, trojans, or related harmful components that could pose risks to the stored information. Despite this, CredAble is committed to securing the Platforms against bugs, viruses, and technical issues, employing industry best practices. The company takes reasonable measures to safeguard User Information, adhering to operational, technical, and organizational standards as mandated by Applicable Law and this Agreement. However, Creditr cannot be held responsible for any damages resulting from various factors such as performance issues, operational failures, technical glitches, or unauthorized access, whether caused by negligence or other reasons.
DISCLAIMER
1. Guidelines, Not Offers: Information and opinions on Platforms about Services are general guidelines, not offers or recommendations from Creditr.
2. Not Legal or Financial Advice: Content on the Platforms is not legal or financial advice.
3. User's Risk: Use of Services is at the User's risk, and Creditr disclaims any warranties.
4. User Responsibility: Users are solely responsible for assessing risks in interactions with others.
5. Creditr’s Limited Liability: Creditr is not liable for Content, deficiencies in Third-Party Service Providers' services, or the accuracy of reports on the Platforms.
6. No Physical Verification: Creditr doesn't physically verify Users and isn't responsible for damages due to Prohibited Conduct or Service suspension.
7. User's Financial Responsibility: Users bear third-party fees and handle disputes with third parties independently.
8. No Governance of Cookies: Creditr doesn't govern third-party cookies and assumes no liability for tailored advertisements.
9. Excused Non-Performance: Non-performance of Services due to various reasons is excused by acts beyond Creditr’s control.
INDEMNITY
Creditr, along with its officers, directors, employees, and agents collectively, shall be indemnified at all times against any losses, costs, expenses, or damages (including reasonable attorney fees) incurred or suffered, whether directly or indirectly, due to the acts or failures to act by any other User, person, or Third-Party Service Provider. This indemnification extends to claims, suits, or legal proceedings initiated by third parties, including but not limited to instances where the User breaches the terms of this Agreement, faces third-party claims related to intellectual property infringement, encounters claims from Government Authorities for violating Applicable Law, or is accused of gross negligence or willful misconduct in connection with the use of Services or this Agreement.
INCONSISTENCY
The terms of this Agreement are to be considered in conjunction with any agreement that Creditr may form with a User regarding the Services or any other services provided by Creditr. In the event of any conflict or inconsistency between (i) the provisions of this Agreement and (ii) the terms outlined in any such agreement between the User and Creditr, the terms of the specific agreement between the User and Creditr will prevail to the extent of the conflict or inconsistency, serving as the governing terms for all purposes.
WAIVER AND SEVERABILITY
Creditr’s failure or delay in exercising any right or remedy does not constitute a waiver of that right or remedy. If any term or condition of the Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, such determination does not affect the validity or enforceability of the remaining terms and conditions. The invalid or unenforceable provision will be interpreted to reasonably align with the actual intention of the party, Creditr, during its drafting.
AMENDMENT
Creditr reserves the right to alter, update, or modify this Agreement, either wholly or partially, without prior notice to the User. However, a notification of such changes, updates, or modifications will be provided on the Services platform. The User's ongoing and uninterrupted use of the Services will be considered as acknowledgment and acceptance of the revised Agreement.
GOVERNING LAW AND JURISDICTION
1. Any dispute, claim, or action related to this Agreement, including questions about its existence, validity, or termination (collectively referred to as "Dispute"), will be governed by the laws of India.
2. Creditr, however, retains the right to initiate proceedings in courts at its sole discretion, if it deems such jurisdiction to be appropriate and convenient.
